Terms of Service

1. Acceptance of Terms & Entity Identity

By accessing, using, or registering for early access to the Kiicare web dashboard or mobile platform ("Service"), you agree to be bound by these Terms of Service. Kiicare is a healthcare technology initiative operated by its founding team in India ("Founders", "we", "us"). Upon formal corporate incorporation, all rights and obligations under these Terms will transfer seamlessly to the registered company. If you do not agree to these terms, you may not use the Service.

2. Description of Service & Medical Disclaimer

Kiicare is a caregiver-first family medication adherence platform allowing family members ("Caregivers") to set up routine medication schedules remotely for elderly family members ("Patients") with local-first full-screen alarms and daily reminders.

CRITICAL MEDICAL DISCLAIMER & CDSCO STATUS: Kiicare is strictly an administrative adherence tracking tool and is NOT a certified Medical Device (SaMD) under the Central Drugs Standard Control Organisation (CDSCO) or Medical Devices Rules 2017 of India.

Kiicare does not suggest medical treatment, calculate drug dosages, or provide clinical decision support. In the event of a medical emergency, call 108 / 112 (India) or 911 (US) immediately or visit the nearest emergency room.

3. Account Eligibility & Age Requirement (18+)

  • Minimum Age: Account creators must be at least 18 years of age to manage family profiles.
  • Accuracy of Data Entry: Caregivers are solely responsible for verifying the accuracy of drug names, dosages, and timings entered into the platform.
  • Patient Consent: Caregivers may not track any adult individual without their explicit, separate consent.

4. Pricing & Early Access Program

Kiicare offers a basic tier that is free forever for up to three (3) family profiles. Any future premium subscription features will be communicated transparently in advance, and you will never be charged without explicit consent.

5. Limitation of Liability & Local Alarm Scope

To the maximum extent permitted under applicable law, Kiicare, its founders, and operators shall not be liable for any indirect, incidental, special, or consequential damages resulting from:

  • User data entry errors or missed dosages.
  • Failure of local alarms due to device battery depletion, operating system battery saver overrides, or device silent mode settings.
Monetary Liability Cap: Under no circumstances shall Kiicare's cumulative monetary liability exceed ₹1,000 INR (or $15 USD for US users), or the total fees paid by you in the preceding 12 months, whichever is lower.

6. Intellectual Property

All branding, logos, software design, interface layouts, and domain names (`kiicare.in`, `kiicare.app`) are the exclusive intellectual property of the Kiicare founding team.

7. Governing Law & Cross-Border Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India and applicable international consumer privacy principles. Any legal dispute or proceeding arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana, India. For international users in the US or global regions, consumer data rights are respected under applicable local privacy statutes.
